Kochi: The High Court on Thursday quashed an FIR registered against JD-S MLA from Angamally Jose Thettayil for alleged rape.
Canceling the FIR, Justice P Bhavadasan upheld contention of Thettayil that he had not committed any offence punishable under IPC section 376 (rape) and the allegations of the woman were absolutely false.
The court said there was no evidence to believe that the woman was subjected to rape. The complainant also failed to prove that the intercourse was not consensual.
Aluva Police had recently registered a case against Thettayil and his son based on the complaint of a woman that she had been sexually harassed by the duo.
The court had twice stayed all further proceedings against Thettayil, former LDF minister, who is the first accused in the case. His son, Adarsh, is the second accused.
Talking to reporters, the MLA said that it was reliably understood that the woman had been instigated by some prominent leaders of the ruling political front to fabricate the case against him and his son with the ulterior motive to tide over the "political crisis prevailing in the state."
Meanwhile, the woman said she would not retreat from the case. She said she would decide on approaching the higher court with the appeal after consulting her advocate.
