SC rejects plea against Jose Thettayil

New Delhi: The Supreme Court has dismissed a petition filed by the Aluva woman alleging rape against Jose Thettayil, MLA.

Observing that Thettayil had not committed rape, the court said the complainant was laying a trap against the MLA.

The court also said the allegations against Jose Thettayil were politically-motivated.

The High Court had on August 1 quashed an FIR registered against JD-S MLA from Angamally Jose Thettayil for alleged rape.

Canceling the FIR, Justice P Bhavadasan upheld contention of Thettayil that he had not committed any offence punishable under IPC section 376 (rape) and the allegations of the woman were absolutely false.

The court had said there was no evidence to believe that the woman was subjected to rape. The complainant also failed to prove that the intercourse was not consensual.

Aluva Police had on June 22 registered cases against Jose Thettayil and his son for sexual harassment following a complaint from a 30-year-old woman that she had been sexually harassed by father and son.

According to the complaint, both father and son had sexually exploited her and Thettayil had promised to get his son married to her.
