Kochi: The High Court on Monday admitted an appeal filed by 12 persons, including three CPM leaders, convicted for the murder of RMP leader T P Chandrasekharan, challenging the sentence awarded to them by the Special Additional Sessions Court, Kozhikode.
A Division Bench comprising Justice K T Sankaran and P Ubaid also sought records from the Special Court.
The High Court sought the view of the state on an appeal filed by the 31st accused, Lambu Pradeepan. Pradeepan was awarded three years’ rigorous imprisonment.
The state sought time and submitted that it too would file an appeal challenging the Special Court order.
The Special Court had awarded life imprisonment to 11 accused in the case.
It has been alleged in the petition that the prosecution ‘miserably’ failed to prove charges against the accused beyond the shadow of reasonable doubts.
The trial was vitiated by serious illegalities. The Special Court also overlooked various circumstances brought on record that militated against the veracity of the prosecution case.
