CJI DY Chandrachud defends collegium system, highlights transparency efforts

New Delhi: Chief Justice of India DY Chandrachud stood in support of the collegium system for appointing judges to the higher judiciary, highlighting the measures taken to enhance transparency in the selection process.
He defended the system, saying that steps have been implemented to ensure due consultation and maintain objectivity in decision-making before a judge's appointment.
In an exclusive interview with news agency PTI, CJI Chandrachud addressed criticism directed at the collegium system, asserting that efforts have been made to uphold transparency within its framework. He highlighted the necessity to maintain privacy during deliberations concerning the careers of high court judges considered for elevation to the Supreme Court.
The collegium system's transparency has been improved, ensuring objectivity in our decision-making process. However, the discussions within the collegium, especially regarding judges' appointments to the Supreme Court, involve considerations of privacy for those under deliberation. These confidential deliberations cannot be publicized or documented, said Chief Justice Chandrachud.
Acknowledging the diverse societal fabric of India, he underscored the importance of trusting the decision-making process. "Criticism of the process is easy, but having been part of it for several years, I assure you that every effort is made to follow due consultation before appointing a judge," he added.
CJI Chandrachud highlighted the collegium's adherence to constitutional and legal directives set by the apex court. He noted the collegium's efforts to enhance transparency by publishing all its resolutions on the website, offering insight into their decisions. Additionally, parameters governing judge selection for the Supreme Court and high courts have been made public to foster transparency.
He explained that the Supreme Court's Centre for Research and Planning aids the collegium by compiling comprehensive data about judges under consideration, providing members with a structured document for evaluating potential appointees.
