HC cancels the order fixing self-financed MBBS course fees

Kochi: The Kerala High Court on Thursday annulled the orders issued by admission and fee regulatory committee (AFRC) pertaining to fixing fees for MBBS at self-financing medical colleges for 2016-17, 2017-18, and 2018-19.

The court set aside the orders for having them been passed by AFRC without required quorum.

A division bench comprising Justice K Surendra Mohan and Justice Annie John directed AFRC to pass fresh orders within two months. However, the court also said the fee fixed by those orders shall be in force as provisional fees until fresh orders are passed.

The college managements argued that none of the orders have been passed by the committee with its full quorum.

All members need not be present, argued the counsel for AFRC, at its meetings as Section 4 permits the committee to formulate its own procedure.
