Young Doctor’s Murder: Kerala police faces flak for omitting murder charge in FIR

Kollam: The Kerala police filed First Information Report (FIR) in connection with the murder of the 22-year-old Dr Vandana Das by a school teacher at a Taluk hospital in Kerala’s Kollam district triggered a controversy for many discrepancies found in it, including the omission of the murder charge against the accused Sandeep.

The accused 42-year-old Sandeep, who was also a school teacher, was brought to the hospital by police on a call from Sandeep who claimed to have been injured by his neighbours and relatives. The incident happened on Wednesday, May 10, at around 4:30 am and the accused hit Dr Vandana, who was in her final year MBBS and doing her house surgency there, with a pair of surgical scissors multiple times injuring her badly to which she succumbed later.

The FIR, which was based on the information provided by a doctor who witnessed the incident, charges Sandeep under Sections 341 (wrongful restraint), 324 (causing hurt by dangerous weapons), 333 (causing grievous hurt), and 307 (attempt to murder) of the Indian Penal Code, as well as offences under the Kerala Prevention of Damage to Private Property and Payment of Compensation Act, 2018, and the Kerala Healthcare Service Persons and Healthcare Service Institutions (Prevention of Violence and Damage to Property) Act 2012.

However, the charge of murder was not included, despite Vandana's death. The police stated that they will revise the FIR.

The Kerala Opposition leader, VD Satheesan, criticized the police for their negligence in the case and pointed out the discrepancies in the FIR. He accused the police of finding ways to avoid their failure in the case, stating that the statements given by the ADGP and what is recorded in the FIR are different. Satheesan also highlighted that Sandeep, who was allegedly a drug addict, was brought to the hospital without even being restrained.

The Kerala police explained the incident to the High Court on May 11, with Additional Director General of Police (Law and Order) A Ajith Kumar telling the court that the protocol for producing a person for medical examination will be reviewed as the current one is insufficient.

Kumar provided a PowerPoint presentation to explain the entire incident, stating that Sandeep had contacted the Kerala police's emergency contact number 112 at around 3:30 am on Wednesday, claiming that someone was trying to kill him. Since he was found injured in his leg, the police took him to the Kottarakkara Taluk hospital.

Kumar explained that Sandeep was calm during his examination at the hospital but suddenly became agitated when his relative who accompanied him helped the nurse by holding his leg. Sandeep kicked the relative initially, seized a pair of scissors, and stabbed the home guard who tried to stop him. Two police officers, including one from the hospital police aid post, and a resident sustained injuries while trying to stop him. Vandana was isolated while other hospital staff locked themselves inside a room after Sandeep turned violent.

On May 10, the Kerala HC had asked the police chief to appear online before the court on the next day morning with a full report. A division bench comprising Justices Devan Ramachandran and Kouser Edappagath held an emergency sitting in the case on May 11.
